Terms of Use (Winion)

These Terms of Use (the “Terms”) govern the use of the Winion service (the “Service”) and constitute a public offer.

By using the Service, the user confirms that they have read, understood, and fully accepted these Terms.

1. Terms and definitions

  • Service (Winion) — a digital platform that provides users with the technical capability to create, publish, and participate in user-generated disputes/events and to express opinions using funds within the platform.
  • User — an individual using the Service via the web interface or Telegram Mini App.
  • Dispute — a user-generated event that implies selecting one of the possible outcomes.
  • Position — the user’s selection of a dispute outcome accompanied by a funds contribution.
  • Dispute pool — the total funds contributed by users within a single dispute.
  • Service fee — the operator’s fee for providing technical infrastructure and servicing the dispute.

2. General provisions

2.1. Сервис не является: букмекерской деятельностью; азартной игрой; казино; финансовым посредником; участником или стороной Спора.

2.2. Все Споры в Сервисе носят пользовательский характер и формируются самими Пользователями.

2.3. Исполнитель не гарантирует: получение прибыли; определённый исход Спора; сохранность средств Пользователя в результате его решений.

3. Исполнитель

Исполнителем Сервиса является:

4. Регистрация и авторизация

4.1. Авторизация Пользователя осуществляется через Telegram Mini App.

4.2. При авторизации Сервис получает ограниченный набор данных: Telegram ID; имя пользователя (username); имя и язык интерфейса (если доступны).

4.3. Сервис не получает и не обрабатывает номер телефона Пользователя, адрес электронной почты или платёжные данные без отдельного согласия Пользователя.

5. Использование Сервиса

5.1. Пользователь вправе: создавать Споры; участвовать в Спорах; приглашать других Пользователей; выбирать Судью (при соответствующем типе Спора).

5.2. Пользователь самостоятельно принимает решение о выборе позиции и размере внесённых средств.

5.3. Все решения Пользователя являются добровольными и осознанными.

6. Денежные средства и комиссия

6.1. Денежные средства, внесённые Пользователями, формируют Пул спора.

6.2. Исполнитель удерживает Комиссию Сервиса в размере 10% от общего Пула спора.

6.3. Оставшаяся часть Пула распределяется между Пользователями, занявшими выигрышную позицию, пропорционально их вкладу.

6.4. Исполнитель не участвует в распределении средств и не является стороной Спора.

7. Bonuses, incentives and anti‑abuse policy

7.1. The Service may, at its sole discretion, grant users bonus funds (the “Bonus USDT”) under marketing, incentive, or testing programs.

7.2. Legal status of Bonus USDT:

  • are not the property of the User;
  • are not money, electronic money or crypto-assets;
  • cannot be exchanged, transferred, sold, or withdrawn;
  • do not create any financial obligations of the Service operator towards the User.

7.3. Bonus USDT are granted exclusively for:

  • testing Service functionality;
  • learning the dispute mechanics;
  • participating in disputes within the platform without using the User’s own funds.

7.4. Any results (including virtual profit) obtained using Bonus USDT, until the required conditions are met, remain part of the bonus program and cannot be withdrawn, exchanged, or compensated.

Conditions to access withdrawals

7.5. To become eligible for withdrawals and/or the return of a fixed bonus amount of 20 (twenty) USDT, the User must generate trading turnover of at least 400 (four hundred) USDT funded exclusively by the User’s own (real) funds.

7.6. Trading turnover means the aggregate volume of all Positions opened by the User using real funds.

7.7. Turnover formed fully or partially using Bonus USDT, as well as any derivatives of such operations, is not counted towards the conditions in clause 7.5.

7.8. The Service reserves the right to determine the source of funds and to classify the User’s operations as bonus-funded or real-funded.

Anti‑abuse and dishonest activity control

7.9. Any actions aimed at circumventing the bonus program conditions are prohibited, including but not limited to:

  • artificial turnover creation (wash trading);
  • participation in linked disputes to obtain a guaranteed result;
  • multi‑accounting;
  • coordination with other users to extract guaranteed benefit;
  • any form of manipulation of the Service mechanics.

7.10. If signs of dishonest activity are detected, the operator may, without prior notice:

  • cancel Bonus USDT;
  • cancel operation results (including profit);
  • deny withdrawals;
  • temporarily or permanently restrict access to the Service;
  • block linked accounts;
  • perform additional checks (KYC/AML at operator’s discretion).

7.11. All decisions made under the anti‑abuse policy are final and not subject to review.

Miscellaneous

7.12. The operator may: (i) change bonus program terms at any time without prior notice; (ii) set individual terms for specific users or groups; (iii) fully discontinue bonus programs.

7.13. Participation in a bonus program constitutes the User’s full and unconditional acceptance of these terms.

8. Ответственность сторон

8.1. Пользователь несёт полную ответственность за: свои решения; выбор позиции; возможные финансовые последствия.

8.2. Исполнитель не несёт ответственности за: убытки Пользователя; действия других Пользователей; решения Судей в Спорах.

8.3. Сервис предоставляется «как есть».

9. Ограничения и запреты

Пользователю запрещается: использовать Сервис в противоправных целях; создавать Споры, нарушающие законодательство; пытаться манипулировать результатами; использовать Сервис для отмывания средств.

10. Прекращение доступа

10.1. Исполнитель вправе ограничить или прекратить доступ Пользователя к Сервису при нарушении настоящего Соглашения.

10.2. Решение о блокировке принимается Исполнителем единолично.

11. Персональные данные

11.1. Сервис обрабатывает минимально необходимый объём персональных данных.

11.2. Обработка данных осуществляется в соответствии с применимым законодательством.

12. Изменения Соглашения

12.1. Исполнитель вправе изменять условия Соглашения в одностороннем порядке.

12.2. Актуальная версия Соглашения публикуется в Сервисе.

13. Применимое право

13.1. Настоящее Соглашение регулируется законодательством Российской Федерации.
